Hypothetical question of the law?

Say some Bad Guy "dumping a lot of chocolate in a black off-leash dog park at the end of this days, the dogs eat and very sick and some die. Is Bad Guy "face the same charges would have received had rat poison spill instead??? The Dark chocolate is toxic to dogs and onions and raisins (), but what counts as a dog poisoning in the eyes of the law?? Or is it just elements that are toxic to living things ALL??

I think it would be too easy for him to say he had no idea that chocolate is toxic, because I did not know until a month ago.
